Another Puzzling Twist in the Najarian Court Case

On September 13, 2008, Grigor Igityan, the former translator and representative for the Najarians, was sentenced to four and a half years imprisonment by the Kentron and Nork-Marash Court on the charge of swindling Carolann and George Najarian out of their personal property. The court decided to let Mr. Igityan free on his own recognizance until the sentence went into effect.

It is satisfactory to the extent that the Court understood the crux of the case; that there was a violation of Article 10 Principle 1, of the European Convention on Human Rights.
It is not complete because we had raised other issues that the Court didn’t deal with. We challenged the fact that the State Committee on TV and Radio isn’t an independent body and that its decisions weren’t substantiated.

Vardan Ayvazyan is Named a Defendant by International Court of Arbitration

On September 5, 2008, the New York base International Court of Arbitration, attached to the International Chamber of commerce, named former ROA Minister of Nature Protection Vardan Ayvazyan, presently serving as President of the National Assembly’s Economic Affairs Committee, as a defendant in a case involving the issuance of mining exploration licenses that Hetq covered in detail at the beginning of this year.

A Grieving Father Cries Out, “Let Them Find My Son’s Killers”

Last year on August 30th, Tigran Ohandjanyan, an enlisted military serviceman, died under suspicious circumstances at the “N” army post. His body was covered with numerous traces of physical violence, something tat was verified by photos taken of Tigran’s body before the autopsy. However, Court Physician Vigen Adamyan hadn’t noticed these traces and concluded that the cause of death was coming into contact with an electrical wire.
Tigran’s father Suren Ohandjanyan notes that, “For example, in one of the photos you can see a telephone number written on the palm of my boy’s left hand.

Another Brazen Killing in Etchmiadzin

On October 12 between the hours of 8:30-9:00 pm Suren Movsisyan, aged 24, was gunned down on Atarbekyan Street in the town of Etchmiadzin. He died after being shot a total of 7 times. The incident has prompted the local Police Investigations Unit to initiate a criminal case in accordance with Section 1, Article 104, of the Armenian Criminal Code.
The murderer chose one of the busiest parts of the town to gun down his victim. There are several commercial businesses in the area along with a taxi-stand and a stop for buses and minivans leaving for Yerevan.

Village Gang Charged With Disrupting Work of “Hetq” Reporters

On July 29th of this year “Hetq” reporters visited the village of Geghamabak in the Gegharkunik Marz to gather information on the activities of the local Municipality. The reporters encountered a group of individuals, lead by Viktor Barseghyan, the village Mayor’s father. Using physical force and intimidation the group began to impede the work of the journalists who were literally forced to leave the scene. 16 Individuals Suspected of Human Trafficking are Sought by Police

In comparison to years past, the number of criminal court cases dealing with human trafficking has gone down dramatically. In other words, either such criminal cases have decreased or law enforcement officials are finding it harder to expose such incidents.
To get to the bottom of the matter “Hetq” has been making inquiries at the Police Department’s Information Division for the past several weeks. We have been trying to make contact with any responsible official at the Police Anti-Trafficking Unit in order to contact an interview. Officials we have spoken to at the Information Division have remained steadfast in their demand that, “all such inquiries should be sent in writing and afterwards we will provide exhaustive answers in detail.”

The Mayor of Ijevan vs. Hetq – Competing Court Suits

As our readers are already know the Ijevan Municipality has initiated a legal suit in the Yerevan Civil Court designed “to compel the refutation of information that has tarnished our working reputation and good name and to seek compensation of incurred losses.” The suit brought by the Municipality demands that, “the Investigative Journalists, NGO be compelled to refute the baseless information published regarding the Ijevan Municipality and news that has tarnished the honor, dignity and working reputation of Ijevan Mayor Varujan Nersisyan.”

Igityan Sentenced to 4 ½ Years in Najarian Fraud Case

Grigor Igityan, who had been charged with defrauding American-Armenian benefactors Carolann and George Najarian out of a substantial amount of property, was sentenced to 4 ½ years imprisonment by the Kentron and Nork Marash Court. The sentence did not include a stipulation regarding a retrieval of the swindled assets.
The trial lasted 18 months. Due to delaying tactics by the defense, the final arguments stage of the trial had been postponed by four months. Finally, on September 9th Defense Attorney Kromvel Grigoryan made his closing arguments whilst the accused, Mr. Igityan, declared that he was innocent of the charges levied against him.

During the past few months the defense counsel has seen to it that the trial sessions are interminably postponed and Judge Zhora Vardanyan has not been able to rectify the matter. The Mayor of Ijevan vs. “Hetq”

In its May 26th edition “Hetq” published an article by Voskan Sargsyan, its reporter in the Tavush Marz, entitled, “Who is pocketing the Profits from the Sand Mine?”. The article exposed facts regarding the illegal extraction of from the White Water reservoir, built along the Aghstev River at the southern entrance to the town of Ijevan. The reporter substantiated his information on site and both photographed and videotaped the entire mining and transportation operation. Mr. Sargsyan also spoke to workers at the reservoir and submitted a list of written questions to those involved in order to obtain some official response regarding what was taking place.

George Najarian’s Lawyer Motions the Court to Detain the Accused

The latest news emanating from the on-going Najarian court case in Armenia is that Grigor Igityan has been charged with using fraud to swindle George and Carolann Najarian, American-Armenian benefactors, out of their property. For the past three years, the time that the trial has been dragging on, the court had constantly refused to bring such charges against the defendant in the case. The Najarians had been waging an uphill battle with the courts during the entire period.

The Son of the General/Parliamentary Deputy Cannot be Punished

After being beaten and horribly tortured in Etchmiadzin on March 13th, 23 year-old Sepuh Karapetyan died. His only ‘crime’ was that he dared to defend one of the neighborhood girls from the person who had been bullying her around. That person was Zarzand Saroyan, the son of Seyran Saroyan who is an Army General and a member of the National Assembly.

The Abovyan Criminal Detention Center is the only prison in Armenia for women and minors. There are currently 126 women here, ages ranging from 19 to 77 years old. 36 of them are detainees. The remaining 90 are convicts, serving their sentences in this prison.

The ‘Zone' is Safe for Women Prisoners

This was the assurance given by Edward Hovhannisyan, head of the Abovyan Detention Center. "It's just that we have a few repeat offenders or people with long sentences, who approach convicts new to the 'zone' and tell them, 'Sister, we know how things are here and we'll tell you what to do and how to do it,' and then they eat the food given to that new convict," said the Detention Center head, "Those are the cunning ones. But the new convicts usually adapt quickly and learn to avoid them."

The Consequences of a “Harmless” Explosion

On October 12 the Court of First Instance of Avan and Nor Nork sentenced Silva Asatryan to nine in prison for organizing an assassination attempt on MP Melik Gasparyan. The would-be assassins were accused of detonating an improvised explosive device attached to the parliamentarian’s car. Gasparyan characterized his survival as a lucky coincidence. But some details suggest that the incident was more likely a handmade “miracle”.

Court Reduces Sentences for Trafficking Convicts

The Court of First Instance of the Shengavit District sentenced Gayane Melkonyan and Susanna Nikoghosyan to five and two years imprisonment respectively on January 31 of this year. In 2004 and 2005, they had gathered a group of Armenian girls whom they tricked and sent to the United Arab Emirates (UAE) and Turkey to work as prostitutes (See: Pimp Sentence to Five Years in Prison). Melkonyan and Nikoghosyan, however, had started their work much earlier.

Society Begins to Lose Faith in the Public Defender

On September 30, the council of the Chamber of Advocates of the Republic of Armenia heard a report by Misha Piliposyan, the office manager of the Public Defender's (PD) office on the work done over the past six months and declared it dissatisfactory. Before hearing the report, the member of the council studied the proceedings of selected public defenders and came to the conclusion that there were, in essence, no proceedings worth noting.
